Rangtel Terms and
Conditions
These Terms of Service
constitute the agreement ("Agreement") between Rangtel and the user
("you", "user", "customer") of Rangtel and this accord is applicable
to any related product or service ("Service"). This Agreement
administrates both the Service and any devices, such as an IP phone,
Rangtel V-Phone, ATA device, or any other IP connection device
("Device" or "Equipment"), used in combination with the Service.
All policies are applicable to each and every Rangtel account
holder. Rangtel has authority to change discussed terms and
conditions written herein without any prior notice or knowledge to
the subscriber.
Common
This agreement is
applicable to you, subscriber. We ("Rangtel ") are committed to
provide better service to our clients and at the same time we expect
from them ("Subscribers") that they should not violate basic purpose
of our service.
You are well aware of and agree not to access our service for any
illegitimate purpose, such as breaking any law, making annoying or
insulting calls or meddling with any other Client’s service. You
give your consent not to resell, shift or allocate your service to
anyone else.
BY ACTIVATING OR ACCESSING THE SERVICE, YOU SIGNIFY THAT YOU ARE
OF LEGAL AGE TO SIGN THIS AGREEMENT AND THAT YOU HAVE READ AND
UNDERSTAND COMPLETELY ITS TERMS AND CONDITIONS.
1. EMERGENCY SERVICES - 911 Dialling THROUGH VoIP Services
1.1
Non-Availability of Traditional 911 or E911 Dialling
Service.
Rangtel provides a form of 911 service (911 Dialling ) that is
similar to traditional 911 service but has some important
differences and limitations when compares with enhanced 911
service (E911) available in most locations in conjunction with
traditional telephone service. With both traditional 911 and E911
Dialling service, your call is sent directly to the closest
emergency response center. Besides in E911 Dialling service,
your call back number and address are visible to the emergency
response center call-taker. In Home Phone's 911 Dialling
service, your call is sent to a national emergency call center.
The call center operator will verify your location information and
then transfer your 911 call to the emergency response center
nearest your location. You should be ready to confirm your address
and call-back number with the operator. Do not hang up unless told
directly to do so and if disconnected, you should dial 911 again.
1. 2 Registration
of Physical Location Required
It is your duty to ensure your location information, when
signed up with Rangtel, is kept updated all times. In case you are
not able to speak during the 911 call, the call taker would
dispatch emergency response vehicles to your last registered
address. You need to update your 911 Dialling information if
you move your device to a different place and/or if you include a
new line to your account. Your 911 Dialling service is
activated when you subscribe to Rangtel Home Phone Service.
1.3 Service Outages.
911 Dialling service will not work in the event of a
power or broadband outage or if your broadband, ISP or Home Phone
service is suspended or terminated. Following a power malfunction
or disruption, you may need to reset or reconfigure your ATA
Device prior to utilizing the service, including 911 Dialling .
1.4 Re-Registration is mandatory if you change Your Number or
Add or Port New Numbers.
It is your responsibility to make sure that you have updated
your information with us whenever you change your number or for
newly added and newly ported number in order for 911 Dialling
to work as deliberated.
1.5 Network Congestion; Reduced Speed for Routing or Answering
911 Dialling Calls.
In our Service, there is a possibility of network congestion
and/or lessened speed in the routing of a 911 Dialling call
as compared to traditional 911 Dialling over traditional
public telephone services.
1.6 Passing on Shortcoming to all resident members, neighbors
and guests.
It is wise to carry forward this message to all members of
your place including guests and other persons who may be present
at the physical location where you access Rangtel Home Phone
service, of the important differences and limitations of VoIP 911
Dialling service as compared with E911 service, as lay down
above.
1.7 Provision of Liability and Indemnification.
In case of 911 Dialling service, we have no direct
control over this service. We depend on third parties to succor us
in routing 911 Dialling calls to local emergency response
centre and to a national emergency calling centre. As we rely on
others in 911 Dialling service, we are not responsible or
have no control over the manner in which, calls using our 911
Dialling service are answered or communicated by any local
emergency response centre.
We refute all responsibilities for the conduct of local emergency
response centre and the national emergency calling centre. We also
disclaim any and all charges against us in the event such third
parties data used to route calls are incorrect or produce wrong
result.
You ("customer") is solely responsible to access our 911 Dialling
service properly and for improper use of this service(911 Dialling
) , you can not held responsible to Rangtel or its employees for
any damage, claim or loss and hence you waive any or all such
claim or actions, may arising from or relating to our 911 Dialling
service.
You are liable to protect Rangtel and all affiliates members and
agents of it, in case any default or misuse of our service,
including 911 Dialling , incorrectly routed 911 Dialling
calls, and /or the inability of any user of the service to be able
to use 911 Dialling or accessing emergency service
personnel, taken place either by you or any third party relating
to you, in such circumstance you have to compensate all losses,
damages, penalties and expenses.
1.8 Alternate 911 Arrangements.
In case if you feel that you are not satisfied with the
shortcoming of our 911 Dialling service, then we strongly
advise you to arrange an alternate means of utilizing traditional
911 or E911 Dialling service or terminating our service to
avoid any risk.
2. SERVICE REGULATION.
2.1 Service Term
The regulations outlined herein are applicable to all the
services which Rangtel renders to its clients. For example (a)
Unlimited Local Calling plan for private and business use (b)
Unlimited Canada Calling plan for private and business use (c)
Home Phone subscribers can access long distance Calling plan along
with Home Phone Package and in that circumstance subscribers do so
in compliance with all applicable rules and regulation sketched
herein. (d) The Home Phone Service may only be used by Subscriber
and somebody else can use it with the consent of Subscriber (e)
Without written consent of Rangtel, Subscriber can not use our
service for other purpose such as for internet connections, faxing
or other data transmission.
2.2 Charges, Billing and Payment
All clients are responsible to pay their bill in due time
along with all others charges which may accompany in their plan.
In addition to the billing amount, they have to pay applicable
federal and provincial taxes. All charges are subject to change
with time and Rangtel has authority to amend any billing
information or rate without prior notice to its subscribers.
All service takers from us are liable to pay the amount which is
incurred by the subscribers or someone else with or without the
knowledge of subscribers. Subscribers will be charged for all
calls (a) made via his/her/their Home Phones; (b) made via any pin
number, access number or authorization access code assigned to
subscriber. It is the responsibility of our clients to make sure
that all secrets information related to that service including
Subscriber’s authorization codes is kept confidential.
We encourage our subscribers to make payment by Credit Card
(Master, VISA) to make it easier. Other options they can pay by
cheque or cash by person in our office. In case of NSF or refused
payment, Subscriber is obliged to pay administrative fee $20 per
occurrence and in case of preauthorized Credit Card charge- backs
a $25 administrative fee will incur. In case of failure to pay any
bill consecutively, in that case Rangtel reserves the right to
charge a 20% administrative fee for all account remitted to
collection department. To get additional monthly statement or call
history, Subscribers have to pay due amount for that service.
Using our Home Phone service, calls make to toll free numbers will
be billed at our North America Long distance rate call. In general
calling rate from our Home Phone service to any other home phone
service is cheaper than calling from our Home Phone service to
some mobile phones in some overseas destinations.
2.3 All Service charges will begin from the day of activation
begin and all charges will be taken first day of every month.
During activation we charge first and last month bill.
Subscriber willing to pay by Credit card, in that case he/she has
to provide credit card information upon subscription or any later
date whenever he/she would like to pay by credit card. Service
charges can aslo be made by Pre-authorized cheque payment and in
this case he/she (Customers) has to provide complete banking
information. Upon giving Credit card information or Pre-authorized
cheque to Rangtel, Subscriber authorizes us to deduct his/her
monthly charges or any other due amount from his/her credit card
or from given authorize bank account.
Without any prior notice, Rangtel has sole authority to alter
billing date. Any dispute or complain regarding payment or
service, should be communicate with Rangtel within 10 days, in
case of failure to convey any such thing to Rangtel within
stipulated period is sole responsibility of the Subscriber and in
such circumstances Subscriber will be obliged to follow the
guidelines of Rangtel.
2. 4 Credit History and Security Deposits
Prior to activation of any account, Rangtel has right to check
credit history of the Subscriber. If Rangtel feels that previous
credit deposit of any customer is not commensurate with the
present situation, in that condition Rangtel can ask for more
credit deposits to continue his/her(Customer) service. Rantel in
its convenience will decide how much credit deposit and what way
should be made by customer. Being an activated Subscriber of
Rangtel, Subscriber entitles us to check his/her (Subscriber)
credit history or to exchange his/ her information with credit
reporting agencies to get updated credit status time to time.
Submission of Devices or Deposits or any other form of Prepayments
made by a Subscriber in connection with the Rangtel Services will
not get any interest or any form of compensation.
2.5 Stipulated Term and MSF Rate Agreement
Rangtel provides services on the following conditions
discussed below and
(i) Home Phone Term Contracts: 1-year and 2 year contracts( N.B. :
at present Rangtel does not implement this policy to its
Subscribers due to promotional offer but when the policy deem
necessary, prior notice will be given to all Subscribers)
Early Cancellation Fee will work: During activation contract term
duration (1 or 2 year) will be written on the first invoice.
Within this contract term, Rangtel gives guarantee to the
Subscriber that the Monthly Service Fee (MSF) remains unchanged.
(ii) Home Phone without Contract: In this case Subscriber can
terminate his/her service without paying any Early Cancellation
Fee (ECF). But in open contract Home Phone service, Rangtel
reserves the right to increase rate of service charge any time
with 30 days prior notification.
(iii) Pre-paid Home Phone Service: This is a special service for
some customers who live away from our periphery (GTA). In this
category service is provided for a precise period of time (For
example $140 paid in advance for 12 months of Unlimited Local
Service) and upon completion of the stipulated time, service will
renewed automatically and Subscriber will be charged once again,
unless we receive any written notice from Subscriber prior to the
anniversary date for any alteration . Subscriber will not get any
refund for any unused months in this service class.
(iv) Long Distance Agreement: Breaking of agreement is subject to
Early Cancellation Fee (ECF).
2.7 Services Interruption
Service of any Subscriber can be interrupted by Rangtel
without any prior notice in order to fix any technical problem or
repair, inspect, replace or to do necessary maintenance on the
telecommunication equipment, facilities or network and in such
circumstances Rangel is not liable to pay any damage or reparation
to any Subscriber.
At the time of Subscription, Subscriber is well informed by
Rangtel staff that in order to access Rangtel Home Phone VoIP
service hassle free, they (Customers) should have high-speed
internet connectivity. Subscriber should take care of issues
related to internet connectivity, power cut off, computer viruses
or any similar concerned and Rangtel does not promise/guarantee to
rectify any such obstacle.
2.8 Rangtel is not responsible for:
(i) Service disruption or unavailability at any time;
(ii) Any issue or error related to any third party service
provider (for example any other telecommunication company, any
connecting carrier or underlying carrier or other provider of
connections, services and facilities);
(iii) Technical or any other problem in Subscriber's equipments or
facilities;
(iv) Unnatural incidents which is not under control of Rangte
including labour conflicts, civil disputes or riots, inclement
weather, lighting , combat or hostility, law and order problem,
regulation of any governing body and any similar outburst;
(v) Failing to maintain committed word to activate the service on
the activation date Subscriber requested;
(vi) Any charges levied by any other companies (other telephone
companies or wireless carriers) for their disbursed services in
the absence of Rangtel Service
2.9 Rangtel Not a Core Telecom Company
Rangtel basically marketing company and deliver its services
combining different entities of many core telecom companies. We
work as an agent of various third party carriers and all accounts
of our Subscribers directly or indirectly depend on their (third
party carriers) services. Rangtel is a self governing body and it
has no obligation or relation with the employees or agents of
other carriers. Rangtel is an independent entity and governed by
itself, therefore subscribing for service with Rangtel, Subscriber
obtains no share and equity, no proprietary right or interest or
any particular privilege pertaining to equipment, telephone number
or code associated with the Service.
3.0 Suspension or
Termination of Services by Rangtel
A. Rangtel has
authoritative power to suspend or terminate services of any
Subscriber, if the Subscriber does not comply with the terms and
condition set by Rangtel. Following actions of the Subscriber can
compel Rangtel to suspend or terminate the account:
(i) If Rangtel does not receive past due, or Subscriber provides
payment by cheque or credit card which is not honoured by
Subscriber's bank;
(ii) fails to provide interim payments when requested, or
Subscriber does not provide a security deposit or arrange
alternate security measurement;
(iii) fails to meet Rangtel's credit requirements, or Subscriber
becomes bankrupt or otherwise insolvent;
(iv) fails to comply with the terms of a deferred payment or
credit agreement with Rangtel;
(v) If Rangtel does not have the capacity to serve the Subscriber
in his/her desired ambit;
(vi) violates any provision of these Terms;
(vii) charges or allows others to charge any other person for the
use of the Services without Rangtel's prior written agreement;
(viii) uses or permits others to use the Services for resell
(ix) Abuses the network with excessive usage as may be determined
by Rangtel. Excessive usage shall be determined solely by Rangtel;
(x) uses or permits others to use the service for commercial or
business use.
(xi) uses or permits others to use the Services for a purpose or
in a manner that is contrary to law; or for the purpose of making
harassing, threatening, abusive, annoying or offensive calls;
(xii) alters or otherwise interferes with Rangtel's facilities or
equipment, or fail to replace or modify equipment or facilities
which may harm, damage, interfere or pose a danger to others, the
Services, or Rangtel's equipment, facilities or network;
(xiii) harasses, threatens or otherwise act unreasonably towards
Rangtel, its employees or agents, or in relation to the Services,
and
(xiv) fails to provide payment for other accounts with Rangtel,
including amounts owed by Subscriber as a guarantor for the
account of another.
B. If a cancellation of any service takes place either by
Subscriber or by Rangtel and in that case if Subscriber has fair
credit balance in his/her account, Rangtel will refund that amount
after deducting any processing fee may apply.
C. Rangtel’s Subscribers are always liable to pay their due amount
even in the case or Termination or Suspension. Due to any reason
it if termination takes place during a contract period, then
Subscriber will be charged for all usages as well as the contract
obligations. In any circumstance a reconnection fee of $ 25 will
be levied.
Terminate Service and
Early Cancellation
Term Contracts: After completion of one year term contract all
contract renew automatically unless requested by Subscriber in
advance. In case of early cancellation Subscriber is responsible for
early cancellation fees.
